MAUI COUNTY VIRTUAL JOB FAIR (MCVJF) DISCLAIMER                                                                           PRIVACY STATEMENT

GENERAL TERMS AND CONDITIONS

The County of Maui and the University of Hawaii, Maui Campus, provide this cost-free resource for the community.  In consideration of the provision of this County-wide resource, Employers agree to the following terms and conditions in the participation in and use of the Website.

In the event, the following conditions conflict with any term, provision, condition, and/or covenant contained in the body of any other agreement, including subsequent amendments, that Employer has with the County, the terms, provisions, conditions, and/or covenants contained in the said body shall prevail.

Employers are invited to register on www.MauiCountyVirtualJobFair.com with general information about their company’s employment opportunities, On-The-Job Training possibilities, and general information to attract interested Job Seekers. Employers are also encouraged to participate in work-based learning opportunities such as job shadowing, mentorship, cooperative education.

A.  JOB POSTINGS, WORK-BASED OPPORTUNITIES, AND RECRUITMENT ACTIVITIES

Upon registering with the MCVJF, the following applies to all employer activities:

  • The MCVJF complies with and requires employers who use our services to also comply with U.S. Equal Employment Opportunity (EEO) and Federal and State Department of Labor guidelines.
  • Contact person(s) must represent legitimate businesses (i.e. legally registered with the Hawaii Department of Commerce and Consumer Affairs or other applicable agency, and are registered with a valid General Excise Tax license).
  • Internship, work-based learning opportunities (both paid and unpaid), and apprenticeships are encouraged but must be approved by the County of Maui or the University of Hawaii, Maui Campus, including at least one of the following areas; job prep/employment services, internship, or service-learning.
  • Job postings and recruitment activities must provide career opportunities offering a legitimate wage or salary.  MCVJF reserves the right to refuse service to any employer or business in accordance with the Conditions for Denial in this document.

B. MCVJF ONLINE EXPECTATIONS OF EMPLOYERS.

To further develop our partnership with employers, meet employer needs, and improve services      to Job Seekers, Maui County Virtual Job Fair has developed the following expectations:

  • Employers are responsible for maintaining their own job listings. This includes posting new jobs, updating the existing job postings jobs as needed, and removing job postings if the position is filled before the posted expiration date.
  • Employers are responsible for maintaining their own “company” and “recruiter” profiles. This includes updating the organization and contact information as needed.
  • If an employer hires an MCVJF Job Seeker, it is expected that the employer will report the hire within the job posting activity by changing the status to “filled.”
  • Participation in surveys and informal opportunities to provide feedback regarding MCVJF services is highly encouraged.

C. CONDITIONS FOR DENIAL OF SERVICES RELATED TO JOB POSTING, WORK-BASED OPPORTUNITIES, AND RECRUITMENT ACTIVITIES.

  • As an advocate for Job Seekers and to promote career employment, MCVJF facilitators reserve the right to not approve job postings based on the following:
  • Refusal or non-compliance of any item listed in Employers, Section A. Job Postings, Work-Based Opportunities, and Recruitment Activities.
  • One-day only jobs (e.g. model, spokesperson, promoter, special event staff, etc.); jobs or work-based opportunities that require the applicant/employee to have a General Excise Tax license and require them to operate as an independent contractor.

D. NO ENDORSEMENT

  • The MCVJF Website is open to all Maui County businesses offering job positions to residents. The County of Maui and the University of Hawaii, Maui Campus, do not control which businesses contribute, or the content on their company websites.
  • Links to external sites are offered to assist in accessing additional information.  The County of Maui and the University of Hawaii, Maui Campus, do not endorse the content or make any assurances as to the accuracy of any listing on an external website.
  • The County of Maui and the University of Hawaii, Maui Campus, are not responsible and expressly disclaim all liability for, damages of any kind, arising out of the use, reference to, or reliance on, any information or business listed throughout the Website.

E. INFORMATION PROVIDED
While the information may be periodically updated, no guarantee is given that the details provided are correct, complete, or current.  It is the Employer’s responsibility to notify the County of Maui and/or when its status or point of contact has changed making modifications are necessary.

F. INDEMNIFICATION
To the extent permitted by law, Employer shall indemnify, defend, release, and hold harmless the County of Maui and the University of Hawaii, Maui Campus, its officers, agents, and employees from and against any and all manner of action and claim arising, either directly or indirectly, out of or resulting from the errors, omissions, or acts of Business Contributor, its officers, employees, or agents occurring during, or in connection with, the participation in or use of the Website. Employer’s obligations under this section shall survive and shall continue to be binding upon Employer notwithstanding the expiration, termination or surrender of the Website.

G. NO DISCRIMINATION
Employers shall not discriminate in the hiring of staff, compensation, terms or conditions of employment of individuals, use of volunteers, or delivery of client services on the basis of sex, sexual orientation, national origin, age, race, color, religion, or disability.  The employer shall comply with all applicable Federal and State laws prohibiting discrimination.

H. PROSELYTIZATION PROHIBITED
An Employer shall not use the Website to recruit or convert a person to a new faith, institution, or cause.

I. LOBBYING PROHIBITED
An Employer shall not use the Website for lobbying purposes or activities.

J. COMPLIANCE WITH LAWS
An Employer shall comply with all applicable Federal, State, and County laws, rules, regulations, licensing requirements, applicable accreditation, and other standards of quality generally accepted in the field of hiring activities. In the event Employer fails to adhere to any of the conditions of the Website, the County of Maui and University of Hawaii, Maui Campus, may withdraw any part or all of the Employer’s information or submissions to the Website at the sole discretion and without advance notice of aforesaid parties.

K. JOB SEEKERS’ RIGHT TO USE
You are granted a non-exclusive, limited, terminable right to access and use this site only for your personal use seeking employment opportunities for yourself. This authorizes you to view and download a single copy of the material on this site solely for your personal, noncommercial use. Your use of this site is a privilege. The Responsible Agencies reserve the right to suspend or terminate your access and use at any time if they determine that you are in breach of any of these Terms.

L. EMPLOYERS’ RIGHT TO USE
You are granted a limited, terminable, non-exclusive right to access and use this site only for your internal business use seeking candidates for employment. This authorizes you to view and download a single copy of the material on this site solely for your use directly related to searching for and recruiting job prospects. The Responsible Agencies reserve the right to suspend or terminate your access and use at any time if they determine that you are in breach of any of these Terms.

M. PRIVACY STATEMENT
This site is strongly committed to maintaining the privacy of your personal information and the security of our computer systems. With respect to the collection, use and disclosure of personal information, the system makes every effort to ensure compliance with applicable Federal law, including, but not limited to, the Privacy Act of 1974, the Paperwork Reduction Act of 1995, and the Freedom of Information Act.

As a general rule, the system does not collect personally identifying information about you when you visit our site unless you choose to provide such information to us. The information we receive depends upon what provided web forms you fill out when visiting our site.

The information is kept on file in a secure database and will only be used by our staff to better provide assistance to you in determining eligibility for federal assistance in obtaining employment and/or training for employment. This information will not be transmitted to other companies, solicitors, or organizations not associated with the performance of the responsibilities delineated in the federal Workforce Innovation and Opportunity Act of 2014.

For security purposes and to ensure that this service remains available to all users, our website also employs software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

Unauthorized attempts to upload information or change information on this service are strictly prohibited and may be punishable under the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act of 1996.
